All eligible Contest name entries meeting the requirements of these Official Rules will be entered into a random prize drawing, to be held on or before October 1, 2024, 11:59 PM EST, by an Obsidi representative.
The potential prize winner (“Winner”) will be selected during this prize draw and will be notified by email within three (3) business days following the selection of Winners. Obsidi shall have no liability for Winner’s failure to receive notices due to message filters, spam filters, account settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within four (4) business days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by the Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT OBSIDIi’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST PRIZE, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
The odds of winning a prize depend on the total number of eligible entries received. Winners are solely responsible for any and all federal, state, provincial, and local taxes that apply to prizes. Sponsor will not replace any lost or stolen prizes.
In order for a Winner to qualify for a prize they must complete the following:
7.a) Winners will be notified by email direct message within three (3) business days of the prize drawing and may be required to sign and return an affidavit of eligibility and publicity/liability release within four (4) days of notification. If a selected Winner cannot be contacted, is ineligible, fails to claim a prize and/or, where applicable, an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, The prize may be forfeited, and an alternate Winner will be selected from remaining eligible entries timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the Instagram account or email address specified in the entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. No automatically generated responses will be accepted.
7.b) Correctly answer a time-limited, mathematical skill-testing question, that will be asked in the affidavit of eligibility and publicity/liability release, without assistance or mechanical aid (such as from a calculator).
7.c) Be eligible according to the Contest Rules and once the skill-testing question has been correctly answered, sign a Declaration and Release form that will be sent by mail, or email and return it, duly completed to Obsidi within seven (7) business days of its receipt. The Declaration and Release requires a Winner to confirm, acceptance of the prize as awarded, agreement to be bound by the Contest Rules, eligibility to participate in this Contest and compliance with these Rules and to release Obsidi, its parent, affiliates, subsidiaries, divisions, dealers, its advertising and promotional agencies, sponsors, suppliers of prizes, materials or services related to this Contest, and all of their respective employees, directors, officers, shareholders, agents, successors and assigns (collectively, the “Released Parties”) from any liability and damages which could arise out of or are in any way related to the Contest and from the awarding, receipt, possession and/or use or misuse of the prize
7.d) If a selected participant (a) cannot be reached by email within three (3) days of the Draw; (b) fails to correctly answer the skill-testing question (see rule 7.b); or (c) fails to return the properly executed Declaration and Release within the specified time (see rule 7.c), then he/she/they will be disqualified and the Sponsor reserves the right, in its sole discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries. The Sponsor will not be responsible for failed attempts to contact a selected participant. Prizes will only be awarded to the person whose full name, address and valid email address appears on the Declaration and Release form submitted.
By entering this content (e.g., photo, video, text, etc.), You understand and agree that Obsidi, anyone acting on behalf of Obsidi, and Obsidi’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Obsidi. If the content of your entry is claimed to constitute an infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Obsidi from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Obsidi may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
Obsidi reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Obsidi’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Obsidi may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Obsidi. Obsidi reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. Obsidi has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different I.P. addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, Obsidi reserves the right to seek damages to the fullest extent permitted by law.
By entering, You agree to release and hold harmless Obsidi and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or their acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
THIS CONTEST IS GOVERNED BY THE LAWS OF CANADA AND ONTARIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ontario having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.
Information submitted with an entry is subject to the Privacy Policy stated on the Obsidi website at https://obsidi.com/privacy-policy. Obsidi will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the corresponding Sponsors whose offers you failed to opt-out. Additionally, by entering the Contest you understand that Obsidi may send you additional commercial marketing emails regarding Obsidi and its partners.

By entering, you agree to be bound by these Official Rules. The Contest is offered by Sponsor, Obsidi, 155 Queens Quay E Suite 200, Toronto, Ontario, M5A 0W4, Canada, which is not responsible for late, lost, delayed, damaged, postage-due, incomplete, illegible, or misdirected entries, responses, or other correspondence, whether by email or postal mail or otherwise, or for theft or destruction or unauthorized access or alterations of entry materials, phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties. By participating and winning a prize, Winner releases Sponsor, its parent, affiliates, subsidiaries, directors, officers, employees, sponsors, and agents, including advertising and promotion agencies, from any and all liability with respect to the Contest or the acceptance, possession or use of any prize, including without limitation (i) any condition caused by events beyond Sponsor’s control that may cause the Contest to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the Prize, or acceptance, possession, or use of the Prize, or from participation in the Obsidi Contest; and (iii) any printing or typographical errors in any materials associated with the Contest. Void where prohibited or restricted by law. All federal, state, provincial, territory and local regulations apply.
Except where prohibited by law, by accepting any prize, Winner consents to the use of their name, photo and/or likeness, biographical information, winning entry and statements attributed to Winner (if true) for advertising and promotional purposes without additional compensation. All entries become the property of Sponsor and none will be acknowledged or returned. Allow 6-8 weeks for delivery of prizes.
Entries are subject to verification by the Contest organizers. The Released Parties will not be held liable for, (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, fraudulent, or illegible Contest entry forms (all of which shall be automatically void and not eligible for the Prizes); (ii) failure to receive Contest entry forms and/or Entries due to transmission failures, busy signals, traffic congestion on the Internet or at any website or technical failures of any kind, including without limitation, malfunctioning of any network servers, access providers, hardware or software, whether originating with sender or recipient; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest and breaches of privacy due to interference by third party computer “hackers”. Obsidi reserves the right to void any Entry and/or cancel or modify the Contest in whole or in part (without notice to entrants individually) if, in its sole discretion, it determines that for any reason (such as tampering or any other cause beyond its control) the Contest is not capable of running as originally planned, fraud, human, printing or distribution errors, or any other causes or occurrences have compromised the administration, safety, fairness or integrity of the Contest. Any person entering this Contest or trying to do so by any means which go against the letter or intent of these Rules and which would be unfair to the other participants (as determined by the Sponsor in its sole and absolute discretion) will be automatically disqualified and Obsidi reserves the right to seek remedies and damages to the fullest extent permitted by law – including criminal prosecution.
The Contest is void where prohibited by law and is subject to all federal, provincial, territorial and municipal laws and regulations. Subject only to the following paragraph, any dispute arising hereunder shall be adjudicated in the applicable court in Ajax, Ontario.
By entering this Contest, entrants accept and agree to be bound by these Rules and the decisions of the Sponsor, which are final, binding and conclusive on all matters relative to this Contest.
